Understanding divorce in California

Going through a divorce is one of the hardest things a family can face. California is a no-fault divorce state, meaning either spouse can file for divorce without proving wrongdoing by the other party. The legal process involves dividing marital assets and debts, determining spousal support, and establishing custody and support arrangements for any children involved.

Every divorce is different. Some are resolved through negotiation and agreement, while others require court intervention. Regardless of your situation, having an experienced family law attorney on your side ensures your rights are protected throughout the process.

The Process

What to expect

1
Initial Filing — One spouse files a Petition for Dissolution of Marriage. The other spouse is served and has 30 days to respond.
2
Financial Disclosures — Both parties are required to disclose all assets, debts, income, and expenses. This is a mandatory step in California.
3
Negotiation or Mediation — Most divorces are resolved through negotiation. Scott works to reach a fair settlement without unnecessary court time.
4
Court Hearings — If agreement cannot be reached, the case goes before a judge who makes the final decisions on disputed issues.
5
Final Judgment — Once all issues are resolved, the court issues a final judgment of dissolution. California requires a minimum 6-month waiting period from the date of service.
