The Process

What to expect

Filing a Petition — A custody petition is filed with the court, either as part of a divorce or as a standalone action.

Mediation — California courts require mediation before a custody hearing. A neutral mediator helps parents reach an agreement.

Temporary Orders — If needed, the court can issue temporary custody orders while the case is pending to ensure stability for the children.

Court Hearing — If mediation doesn’t resolve all issues, a judge hears both sides and makes a custody determination based on the child’s best interest.

Final Custody Order — A formal custody and visitation order is issued by the court. This order is legally binding and enforceable.
